Cynthia Ritchie challenges court order on filing FIR against her

Islamabad (HRNW) American blogger Cynthia Dawn Ritchie approached the Islamabad High Court on Thursday and challenged the ruling of a district and sessions judge instructing the FIA to file a case against her for defaming former PM Benazir Bhutto.

She has named the Justice of Peace, FIA and Pakistan Telecommunication Authority as respondents in the case.

The petition says that the order has been passed “illegally and unlawfully”. The “real controversy was not looked into” and the court “straight away passed an order of registration of an FIR”.

Matters pertaining to the PECA are to be “tried by a special court designated by the high court, hence an ordinary court has no jurisdiction to entertain any application regarding a special law,” the petition said.

“Under the FIA laws, registration of FIR is not mandatory, its always subject to the result of an inquiry and the FIA has been vested with the power to refuse to register an FIR if during the inquiry the information is found to be false,” it added.

On June 15, an additional district and sessions judge directed the FIA to file a case against the blogger for passing defamatory remarks about Benazir Bhutto on social media.
