Daimler unsuccessful in appealing German vehicle authority’s recall

German carmaker Daimler was unsuccessful in its efforts to stop a diesel vehicle recall ordered by the government’s vehicle authority, which rejected almost every one of the appeals.

In one case, the manufacturer’s justification was missing, so it was not possible to decide conclusively, the Transport Ministry said.

Daimler is among several carmakers that have been accused of violating pollution regulations and even manipulating exhaust systems to make emissions seem lower than they were in reality.

Hundreds of thousands of its Mercedes-Benz cars were outfitted with the technology, which Daimler maintains is permissible. The carmaker is recalling the vehicles, but it has appealed against all the notices.

The company said that it was examining the reasons given by the vehicle authority and would decided whether it would go to court.

A lawsuit would be the next possible legal remedy, said the ministry.
