Schweinfurt confirmed as Schalke cup opponent after legal dispute

Munich (dpa) – Fourth-division Schweinfurt were on Tuesday confirmed as opponents of Schalke in the first round of the German Cup next week after a lengthy legal battle.

An arbitration court of the Bavarian football body BFV ruled that the BFV made the correct decision earlier in the year as it dismissed an appeal from Munich club Tuerkguecue.

With both clubs in the fourth tier when the past season was abandoned owing to the coronavirus, the BFV promoted then leaders Tuerkguecue into the third division and gave the cup slot to second-placed Schweinfurt.

Tuerkguecue said they should get the cup berth and reached an injunction at a Munich civil court. A district court then said that the BFV should have another look at its decision, while another court then confirmed that the case must be decided by sports authorities.

The BFV arbitration panel made up of independent judges now confirmed the original decision.

The first-round match was originally scheduled for September 13. It has been rescheduled for November 3.
